Oscar Pistorius’s conviction changed to murder

judge-leach-and-oscarDisgraced paralympian Oscar Pistorius’s culpable homicide conviction has been over-turned to murder in the Supreme Court of Appeal in Bloemfontein.

Justice Eric Leach has just finished reading the judgment in the case between the State and Pistorius.

He poked holes in High Court Judge Thokozile Masipa’s verdict and found that the trial incorrectly applied the principle of dolus eventualis – which deals with indirect intention to kill.

Justice Leach also said Judge Masipa didn’t take into account relevant circumstantial evidence.

The Appeal Court has found that the trial court has incorrectly applied the principle of dolus eventualis – which deals with indirect intention to kill.

Justice Leach has been reading summary of the judgment in the matter involving the State and paralympian Oscar Pistorius.

Leach has further highlighted that one does not have to foresee the identity of a person to kill and has made an example about a bomb being set off.

Reeva’s mother June Steenkamp was at court dressed in a black suit. When she arrived in court she was met by a large contingent of reporters and camera personnel.

Members of the ANC Women’s League were also in court, which was packed to capacity.

Pistorius’s lawyer Advocate Barry Roux refused to concede that Pistorius knew his actions had been unlawful

The State wanted the Paralympic gold medallist to be convicted on a more serious charge of murder which carries a minimum sentence of 15 years in prison. –>> SABC
